Privacy Policy
This Privacy Policy describes how Presencia ("we," "us," or "our") collects, uses, and protects information about you when you use our website and software platform (the "Service"). By using the Service, you agree to the practices described in this Policy.
1. Information We Collect
a. Information You Provide Directly
- Account information: Name, email address, and password when you create an account.
- Business information: Business name, category, address, phone number, email, services offered, and other details entered during onboarding or in your dashboard.
- Content: Photographs, logos, and other media you upload to your website or profile.
- Communications: Messages you send to our support team.
- Payment information: Billing details collected by our payment processor, Stripe. Presencia does not store or have access to full credit card numbers. Payment data is governed by Stripe's Privacy Policy.
b. Information Collected Automatically
- Usage data: Pages visited, features used, time and duration of sessions, and actions taken within the Service.
- Device and technical data: IP address, browser type, operating system, and device identifiers.
- Cookies and similar technologies: See Section 5 for details.
c. Information From Third Parties
- Review and rating data from Google Business Profile and other platforms, accessed via official APIs with your authorization.
- Referral information (e.g., if you arrived via an affiliate referral link).
2. How We Use Your Information
We use information we collect to:
- Create and maintain your account and provide the Service;
- Generate your AI-powered website and digital marketing content;
- Process subscription payments and manage billing;
- Send transactional emails (account verification, billing receipts, trial expiration notices);
- Monitor review platforms on your behalf and generate AI-drafted responses;
- Provide customer support and respond to inquiries;
- Improve, personalize, and expand the Service;
- Detect, investigate, and prevent fraud, abuse, or security incidents;
- Comply with applicable legal obligations;
- Communicate material updates to these policies or the Service.
We do not use your personal data for behavioral advertising and we do not sell your personal data to third parties.
3. How We Share Your Information
We do not sell, rent, or trade your personal information. We share information only in the following circumstances:
- Service providers: We share data with third-party vendors who assist us in operating the Service (see Section 4). These parties are contractually bound to protect your data and may only use it to perform services on our behalf.
- Your public website: Business information, content, and contact details you add to your Presencia website are published publicly on your behalf per your instructions.
- Legal requirements: We may disclose information when required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect rights, safety, or property.
- Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will notify you before your data is subject to a different privacy policy.
- With your consent: We may share information for any other purpose with your explicit consent.
4. Third-Party Service Providers
We rely on the following key sub-processors to operate the Service:

5. Cookies and Tracking Technologies
We use the following types of cookies:
- Strictly necessary cookies: Required for authentication, session management, and core Service functionality. These cannot be disabled.
- Preference cookies: Used to remember settings such as referral codes (via httpOnly cookies) to attribute affiliate referrals correctly.
We do not use analytics cookies, advertising cookies, or cross-site tracking technologies. You can configure your browser to block cookies, but doing so may impair the functionality of the Service.
6. Data Retention
We retain your personal data for as long as your account is active or as necessary to provide the Service. If you cancel your subscription, your data is retained for sixty (60) days to allow account reactivation, after which it is permanently deleted from our systems. We retain transaction records (invoices, payment history) for up to seven (7) years as required by applicable tax and accounting laws.
7. Data Security
We implement industry-standard technical and organizational security measures, including encryption in transit (TLS), encrypted data storage, access controls, and Row-Level Security (RLS) in our database. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information and you use the Service at your own risk.
In the event of a data breach affecting your personal information, we will notify you and relevant authorities as required by applicable law.
8. Your Rights and Choices
Depending on your location and applicable law, you may have the following rights:
- Access: Request a copy of the personal data we hold about you.
- Correction: Request correction of inaccurate or incomplete information.
- Deletion: Request deletion of your personal data, subject to legal retention obligations.
- Portability: Request your data in a structured, machine-readable format.
- Opt-out of marketing: Unsubscribe from any promotional emails using the link in the email footer. Note: transactional emails related to your account cannot be opted out of while your account is active.

9. Florida Privacy Notice
Presencia operates under the laws of the State of Florida. We comply with applicable Florida privacy requirements, including the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171, which governs the security of personal information and breach notification obligations for businesses operating in Florida.
We do not sell personal information to third parties. We do not use personal information for targeted advertising. We do not engage in profiling that produces legal or similarly significant effects on individuals.
10. Children's Privacy
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected data from a child, please contact us immediately via our Support page and we will promptly delete the information.
11. International Users
Presencia is operated in the United States. If you access the Service from outside the United States, your data will be transferred to, stored, and processed in the United States and other countries where our service providers operate. By using the Service, you consent to this transfer. We take appropriate safeguards to ensure your data receives adequate protection.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email and post the updated policy with a new effective date. Your continued use of the Service after the effective date of the revised policy constitutes your acceptance of the changes.
